FORMATION OF THE CONTRACT

  • 1.1: These terms of sale apply to all goods and services supplied by Microbuild (“the Supplier”) (“the Company”).
  • 1.2: No contract exists between you and the Supplier for the sale of any goods or services until the Supplier has received your order and sends you confirmation by email to the email address you have given. Once the Supplier does so, there is a binding legal contract between us.
  • 1.3: The contract is subject to your right to cancellation (see clause 5 below).
  • 1.4: The Supplier may change these terms of sale without notice to you in relation to future sales.

DESCRIPTION AND PRICE OF THE GOODS

  • 2.1: The description and price of the goods you order will be as shown on the Supplier’s website at the time you place your order.
  • 2.2: The goods are subject to availability. If on receipt of your order the goods you have ordered are not available, the Supplier will inform you as soon as possible with anticipated stock availability, suggested alternatives or offer to refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
  • 2.3: Every effort is made to ensure that prices shown on the Supplier’s website are accurate at the time you place your order. If an error is found, the Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, the Supplier will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
  • 2.4: The price of the goods and services are inclusive of VAT (if payable) and UK Mainland delivery.
  • 2.5: Manufacturers may change product specification without notice therefore all product images are displayed for illustrative purposes only.

  • 3.1: Payment for the goods and services can be made by any method shown on the Supplier’s website at the time you place your order.

DELIVERY

  • 4.1: The goods you order will be delivered to the address you give when you place your order.
  • 4.2: You may request alternative delivery periods during the ordering process.
  • 4.3: If there is no one at the address given who is competent to accept delivery of the goods, you will be notified of an alternative delivery date or a place to collect the goods.
  • 4.4: Every effort will be made to deliver the goods as soon as possible after your order has been accepted, and in any event within 30 days of your order. However, the Supplier will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery. In this case, the Supplier will inform you as soon as possible.
  • 4.5: You will become the owner of the goods you ordered and responsible for risk of loss of or damage to them once they have been delivered to you.
  • 4.6: When you sign for the goods (i.e. sign the couriers delivery sheet), you are accepting the goods in the condition that you receive them. Once the goods have been signed for in the condition that you receive them, the liability for any physical damage to the computer is released from the couriers responsibility and becomes yours.

    IT IS STANDARD PRACTICE TO CHECK THE CONTENTS FOR PHYSICAL DAMAGE BEFORE YOU SIGN FOR THEM AND BY ACCEPTING OUR TERMS AND CONDITIONS YOU AGREE TO THE FOLLOWING:

    • If the goods are damaged before you sign for them, you will sign for them as “damaged goods” or according to the condition that they have been received in order to maintain your delivery insurance.
    • If you cannot check the goods before signing for them, you (or the person who signs for them) must sign for them as “unchecked” in order to maintain your delivery insurance.
    • Failure to comply to the terms will void your delivery insurance on the computer, and if there is physical damage you will have to pay for the repair.

YOUR RIGHT OF CANCELLATION

The right of cancellation is governed by the “Distance Selling Regulations 2000” which can be read here.
  • 5.1: You have the right to cancel the contract at any time up to the end of 7 days after you receive the goods. Please see 13 of the Distance Selling Regulations 2000 for exceptions.
  • 5.2: To exercise your right of cancellation, you must give written notice to the Supplier by email at the email address shown below giving details of the goods ordered and (where appropriate) their delivery.
  • 5.3: If you exercise your right of cancellation after the goods have been delivered, you will be responsible for returning the goods to the Supplier at your own cost. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit.
  • 5.4: Once you have notified the Supplier that you are cancelling the contract, the Supplier will refund or re-credit you within 30 days for any sum that has been paid by you for the goods.
  • 5.5: The cost of packaging a product and then delivering the goods to the customer is exluded from any refunds as this is a service that is seen to be completed when the product first arrives to the customer.
  • 5.6: Refunds cannot be given for any software purchased that has been opened (i.e. seal or outer packaging removed) or activated, as activated software is tied to the user and computer used to activate it.
  • 5.7: If you do not return the goods as required your cancellation will not be effective.
  • 5.8: In rare circumstances and subject to the ultimate discretion of the Supplier, the company may issue a part or full refund even if the company is complying to the Distance Selling Regulations 2000, for the convenience and well-being of the customer.

WARRANTY

  • 6.1: All goods supplied by the Supplier are warranted free from defects for a period specified by the original manufacturer from the date of supply. This warranty does not affect your statutory rights as a consumer.
  • 6.2: Goods found to be defective under the manufacturer’s warranty will be replaced or repaired as specified by the terms of the manufacturer’s warranty.
  • 6.3: Warranties do not apply to any defect in the goods arising from fair wear and tear, wilful damage or accident.
  • 6.4: If the goods supplied to you develop a defect while under warranty, or you have any other complaint about the goods, you should notify the Supplier as soon as possible.
  • 6.5: If an item purchased from Microbuild is returned to the company and found not to be defective, you will be charged for the return delivery costs of the item as well as the collection costs. This currently stands at 45 + VAT. We reserve the right to charge for labour if we deem this is necessary.
  • 6.6: We offer a free collection and re-delivery service for our computer systems. Should your computer system develop a defect within the first 12 months after the delivery date, we will collect the item from you, and repair or replace it with an item identical or of equal value as soon as practicably possible. You will be responsible for ensuring the item is packaged suitably and safely until we confirm the item has arrived back to us safe and secure. We will only confirm this once we have opened the item and one of our employees has inspected the item. We recommend that you keep the original packaging that your computer system/keyboard/mouse or speakers arrive in for the purpose of returning an item back to us if necessary. We will then re-deliver the item back to you free of charge. Any "loss of earnings" or inconvenience caused as a result of a failure of any item purchased from Microbuild will not be compensated for.
  • 6.7: If you receive damaged goods, you will need to notify Microbuild within 3 working days in order to qualify for free collection, repair or replacement. If do not notify us of any damage (i.e. cracked case) within 3 working days, you will not be able to return the items to us for repair or replacement.
  • 6.8: Manufacturer’s warranties do not cover damage caused by you moving, replacing or installing supplied or additional components. You must ensure that if you intend to open your computer case and are unclear or unsure of anything, you will contact us for confirmation prior to changing your computer’s configuration.
  • 6.9: Should you take your computer system, monitor, keyboard or mouse, or any other peripheral to another computer company, repair company or computer technician and have them attempt to diagnose or repair a fault on the computer, you will VOID all warranties on the computer. If you have any problems with your computer you must contact us for advice and if necessary obtain an RMA number and return the item to us through our returns procedure. (see warranty 6.6).

DATA PROTECTION

  • 7.1: The Supplier receives orders and payments via a secure server and the Supplier will take all reasonable precautions to keep the details of your order and payment secure, but unless the Supplier is negligent, the Supplier will not be liable for unauthorised access to information supplied by you.
  • 7.2: The Supplier will only use the information you provide about yourself for the purpose of fulfilling your order.
  • 7.3: All transaction information passed between our site and the Sage Pay VSP Systems is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to our servers from Sage Pay are signed using MD5 hashing to prevent tampering. You can be completely secure in the knowledge that nothing passed to the Sage Pay servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.
  • 7.4 Once on the Sage Pay systems, all sensitive data is secured using the same internationally recognised 256-bit encryption standards used by, among others, the US Government. The encryption keys are held on state-of-the-art, tamper proof systems in the same family as those used to secure VeriSign's Global Root certificate, making them all but impossible to extract. The data held by Sage Pay is extremely secure and Sage Pay are regularly audited by the banks and banking authorities to ensure it remains so.

  • 9.1: These terms of sale and the supply of the goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.
